These Terms of Service govern your use of theindiegamesroom.com (“the website”), which is operated by Anna Lupii, 10B Akademika Korolova Street, Kyiv, 02000, Ukraine (“we”, “us”) for the Tafløy Lofoten Resort & Casino project. By using the website, you accept these terms. If you do not agree with them, please do not use the website. Joining the interest list is covered separately by our Terms and Conditions.
1. What this website is
This is an information website about a resort that is being planned on an island in Lofoten, Norway. The resort has not been built and is not operating. The website does not take bookings or reservations, does not accept payments and does not sell any goods or services. Nothing on it is an offer to enter into a contract, and no contract is formed by visiting it or by writing to us.
The website does not offer any games, gambling or betting, whether for money or for free. References to the Games Room describe a planned room for board games at the resort, and references to the entertainment and gaming lounge describe a planned space that is subject to licensing and may never open.
2. Who may use it
The website is intended for adults aged 18 and over. Parts of it describe a planned gaming lounge that would be open only to adults, and the interest list is open only to adults. You are responsible for making sure that your use of the website is lawful where you are.
3. Intellectual property
The texts, artist’s impressions, photographs and illustrations, the design and layout, the Tafløy name, the logo and the board-square monogram are owned by us or used with permission. They are protected by copyright, trade mark and other laws.
You may view the website, print or save individual pages for your own personal, non-commercial use, and share links to it. Without our prior written permission you may not copy, republish, adapt or distribute its content, use its images or texts in other publications, advertising or commercial material, or include them in datasets used to train software. The typefaces used on the website, Young Serif and Nunito Sans, are licensed under the SIL Open Font License. Names of other organisations and properties that appear on the website, such as Norsk Tipping, Norsk Rikstoto, Hjelpelinjen, Aria Resort & Casino and Grand Portage Resort, belong to their respective owners. Mentioning them does not imply any connection with, or endorsement by, those owners.
4. Acceptable use
When using the website, you must not:
- attempt to gain unauthorised access to the website, its server or any connected system, or test, probe or scan them for vulnerabilities without our written permission;
- interfere with the website’s operation or security measures, including its Content Security Policy, or introduce malware or other harmful code;
- use automated tools to copy or collect content in a way that places an unreasonable load on the website;
- use our email addresses to send unsolicited bulk messages, or content that is unlawful, abusive, threatening, defamatory or misleading;
- pretend to be us, or suggest that you act on our behalf, for example by asking anyone for deposits or payments connected with the resort;
- use the website in any way that breaches applicable law.
We may block access to the website for anyone who breaches these rules, and we may report unlawful activity to the competent authorities.
5. Information about the project
We try to keep the information on the website accurate, but it describes a project in development. Names, layouts, room types, areas, capacities, facilities, services, the gaming lounge and any dates may change or be dropped as planning, permits, licensing and construction progress. Figures are planned figures, and images are artist’s impressions, not photographs of existing buildings. Please do not make travel plans, financial commitments or other decisions on the basis of the website alone.
6. Links to other websites
The website links to a small number of external websites, such as those of Hjelpelinjen and data protection authorities. We have no control over their content or practices, and we are not responsible for them. A link is not an endorsement of everything on the linked website.
7. Availability and changes
The website is provided free of charge and “as is”. We do not guarantee that it will always be available, uninterrupted or free of errors, and we may change, suspend or withdraw all or part of it at any time, for example for maintenance or when the project changes.
8. Limitation of liability
To the extent permitted by law, we are not liable for any loss or damage arising from your use of the website, from your reliance on information published on it, or from your inability to use it. This includes, for example, costs of travel or other arrangements made in the expectation of an opening date, a facility or a service that later changes or does not materialise.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for intent or gross negligence, or for death or personal injury caused by negligence. Nothing in these terms affects your statutory rights as a consumer.
9. Privacy
How we handle personal data is explained in our Privacy Policy. The only information the website stores on your device is described in our Cookie Policy.
10. Governing law and disputes
These terms are governed by the law of Ukraine. If you are a consumer living in Norway or elsewhere in the EEA, you also keep the protection of the mandatory provisions of the law of the country where you live, and nothing in these terms deprives you of that protection. Disputes may be brought before the competent courts of Ukraine; as a consumer, you may also bring proceedings in the courts of your country of residence where the law allows it.
